Name, Image, and Likeness (NIL)

    Policy Purpose

    1. The purpose of this policy is to ensure the University of North Georgia (the University/UNG) complies with state, federal, and NCAA (National Collegiate Athletic Association) legislation regarding Name, Image, and Likeness Activities.

    2. Name, image, and likeness regulations will provide opportunities for our student-athletes and allow them to benefit from the use of their names, images, and likenesses.

    3. As regulatory agencies and governments continue to discuss the importance of creating federal legislation for name, image, and likeness, the following guidelines and policies have been adopted by UNG, effective November 15, 2021, to ensure compliance with all state, system, University, and NCAA mandates.

    Definitions

    Name, Image, and Likeness Activity (NIL):  Any activity in which a prospective student-athlete or student-athlete’s name, image, and likeness or personal appearance is used for promotional purposes by a non-institutional entity, including the individual prospective student-athlete or student-athlete, a commercial entity, or a non-institutional non-profit or charitable entity. Such use may be compensated or uncompensated.

    Policy Statement

    1. A UNG student-athlete may receive NIL payments for the use of that student-athlete’s name, image, and likeness.

    2. UNG will not reduce or revoke a student-athlete’s athletic eligibility, grant-in-aid, scholarships, education benefits, or otherwise impose an adverse consequence against a student-athlete as a result of a student-athlete receiving payment for the use of NIL or obtaining professional representation, unless in doing so the student-athlete violates any applicable law, NCAA bylaw, University policy, team policies, or procedures or rules adopted under this policy.

    3. The following rules apply to UNG student-athletes who choose to use their name, image, likeness to earn compensation:

      1. Prospective student-athletes must comply with any applicable state or federal NIL laws, and upon becoming a UNG student-athlete must conform their NIL activities to this policy and any applicable NCAA and/or Peach Belt Conference (PBC) requirements.

      2. The use of a student-athlete’s name, image, and likeness may not be related to pay-for-play or any improper recruiting inducements by the University and/or its representatives with an athletic interest (e.g. boosters) including, but not limited to:

        1. NIL agreement with quid pro quo (e.g. compensation for work not performed.

        2. NIL compensation provide or offered contingent on initial or continued enrollment at a particular institution.

        3. NIL compensation contingent on specific athletic performance or achievement (e.g. financial incentives based on points scored). Athletic performance may enhance a student-athlete’s NIL value but athletic performance may not be the consideration for NIL compensation.

        4. Benefits provided to student-athletes that are inconsistent with institutional policies (e.g. benefits or arrangements not available to the general student body).

        5. A UNG student-athlete may not engage in any NIL Activity in a manner that conflicts with a term of a University of North Georgia contract.

        6. A UNG student-athlete may not engage in any NIL Activity that promotes products or services related to gambling or performance-enhancing supplements on the NCAA’s banned drug list.

        7. A UNG student-athlete may not engage in any NIL Activities during any department- or team-related activities (e.g. practice, competition, team meals, travel, etc.).

        8. A UNG student-athlete’s use of the name, symbols, logos, trademarks, facilities, or images associated with the UNG Athletic Department or the University of North Georgia must be in accordance with University policy and with specific approval in advance.

        9. A UNG student-athlete must disclose NIL Activities to UNG within a reasonable time using the Name, Image, and Likeness Disclosure Form on ARMs.

    4. A UNG student-athlete may obtain professional representation by an athlete agent, attorney, or financial advisor who is engaged by the student-athlete for the purpose of securing payments for the use of the student-athlete’s name, image, and likeness, or otherwise advising the student-athlete concerning NIL. All representation should be disclosed to UNG using the Name, Image, and Likeness Disclosure Form.

    Procedures

    Any related operating procedures must comply with and should reference this policy.
